<p>Workplace discrimination is defined in the Employment Equity Act (EEA) Section 6(1) as follows:</p>
<p>“No person may unfairly discriminate, directly or indirectly, against an employee, in any employment policy or practice, on one or more grounds, including race, gender, sex, pregnancy, marital status, family responsibility, ethnic or social origin, colour, sexual orientation, age, disability, religion, HIV status, conscience, belief, political opinion, culture, language, birth or on any other arbitrary ground.”</p>
<p>However, in a recent Labour Court judgement (Naidoo v Parliament of the Republic of South Africa), argued for a clearer interpretation of “any other arbitrary ground” – an interpretation that must be informed more by the Constitutional definition of discrimination.</p>
<h2><strong>Different Types Of Workplace Discrimination</strong></h2>
<p>Fair discrimination</p>
<ul>
<li><strong>Compulsory discrimination</strong>: It is illegal for a company to employ children under the age of 15 years or pregnant women four weeks before confinement and six weeks after giving birth.</li>
<li><strong>Discrimination based on inherent requirements for a job</strong>: Employers reserve the right to discriminate based on whether the candidate or employee has the necessary skills or capabilities to do the work required. For example, you wouldn’t expect an airline to employ someone with poor eyesight as a pilot.</li>
<li><strong>Discrimination based on productivity</strong>: It’s fair for employers to discriminate on the basis of an employee’s productivity when considering their candidacy for a pay increase. However, this is dependent on the fairness of the criteria, with which the employer assesses performance and productivity.</li>
<li><strong>Discrimination based on affirmative action</strong>: Any company should be mindful of affirmative action measures that promote fairness in favour of previously disadvantages groups. The goal of affirmative action is to achiever employment equity in the workplace without lowering standards or unduly limiting the prospects of existing employees.</li>
</ul>
<p>Unfair discrimination</p>
<ul>
<li><strong>Direct discrimination</strong>: The more obvious form of unfair discrimination, involving discrimination based on one’s sex, race, religion, sexual orientation, marital status, etc.</li>
<li><strong>Indirect discrimination</strong>: This form of discrimination could arguably fall under the “any other arbitrary ground” label. It is defined as structural practices and policies in a workplace that affect certain groups negatively. The interpretation of this concept is usually left up to the Equal Employment Opportunity Commission and the courts.</li>
</ul>
<h2><strong>How To Report Unfair Discrimination</strong></h2>
<ol>
<li>Keep a record of instances of discrimination. Emails or some kind of paper trail is best, but otherwise a journal is a good place to record persistent workplace harassment or discrimination. Even better is if there are colleagues, who also feel affected by instances of unfair discrimination.</li>
<li>First speak to your supervisor. However, if your supervisor is the perpetrator of said discrimination, go straight to the next link in the chain of command.</li>
<li>If the discrimination persists and nothing is done to address it, approach the CCMA or any workers union, with which you may be affiliated.</li>
</ol>
<p>Section 11 of the Employment Equity Act 55 of 1998 gives criteria for how to approach discrimination allegations.</p>
<p>Firstly, if a company is taken to task about an instance of discrimination, it’s up to said company to bear the burden of proof. The accused organisation must be able to prove, on a balance of probabilities:</p>
<ol type="a">
<li>the discrimination did not take place as alleged, or</li>
<li>the discrimination is rational and not unfair, or is otherwise justifiable.</li>
</ol>
<p>However, if unfair discrimination is alleged on an arbitrary ground, it’s up to the complainant that must prove, on a balance of probabilities, that:</p>
<ol type="a">
<li>the conduct complained of is not rational,</li>
<li>the conduct complained of amounts to discrimination, and</li>
<li>the discrimination is unfair.</li>
</ol>

Even if the employer has to resort to short-time (reducing the number of regular work hours), they can rest assured that their employees can continue to deliver on their work requirements. If an employee can work during lockdown, they have a contractual obligation to do so.</p>
<p><strong>Essential services</strong>: During the lockdown, there are a number of industries and services still in operation. These include health workers, emergency personnel, those in security services, financial service providers, and other persons needed to respond to the COVID-19 emergency.</p>
<p><strong>Complete shutdown</strong>: A company would be forced to completely stop all operations in two instances. One is if employers cannot provide the resources or the funds to enable their employees to work from home. The other is if the company’s operations cannot be conducted without compromising the new safety measures (e.g. social distancing).</p>

<h2><strong>Annual Leave</strong></h2>
<p>The question of whether or not employees would be forced to use up their annual leave has been on many minds. And this is not a recent concern. Even when talk of a national lockdown was just a rumour, employees were terrified whether they’d have enough paid leave to last them through this necessary house-arrest. Would employees have to resort to unpaid leave? Could sick leave be converted into extra annual leave days? Or would a special self-quarantine leave apply?</p>
<p><strong>Forced annual leave</strong>: Although employers are within their rights to force employees annual leave, the Departments of Labour strongly advises against this or to rather view this as a last resort. Under these conditions, employers may determine when employees may take leave. Sick leave may not be used to substitute annual leave. Once an employee runs out of paid annual leave, they would default to unpaid leave.</p>
<p><strong>Unpaid leave</strong>: If an employee is unable to deliver on their work obligations and has no annual leave available, the employer may invoke the no-work-no-pay principle. These employees would have to claim from the Unemployment Insurance Fund (UIF) to cover their basic cost of living during the lockdown.</p>
<p>Public holidays still apply; employers cannot force their employees to work on these days.</p>

<h2><strong>Misconduct And Disciplinary Action During Lockdown</strong></h2>
<p>This national lockdown due to COVID-19 throws a proverbial spanner in many works. Companies must continue to operate wherever possible. This includes dealing out disciplinary action to employees, who have misrepresented the organisation (e.g. on social media) or abused their position prior to the lockdown taking effect.</p>
<p><strong>Suspensions</strong>: If an employee was suspended prior to lockdown, their suspension may be lifted to allow them to work during the lockdown and maintain an income. However, employers must consider the reason for suspension in these cases. For instance, if an employee was facing disciplinary action for industrial espionage, lifting their suspension may prove unwise.</p>
<p><strong>Giving notice</strong>: If an employee gave notice before the lockdown went into effect and can still work during the lockdown, their notice period still applies. However, if an employee, who gave notice previously, cannot fulfil their work obligations during the lockdown, their notice period could potentially be extended, unless the employee uses their annual leave.</p>
<p>Any employee, who is not involved in a business delivering an essential service and cannot conduct business from home, should not be forced to work during this lockdown. Any victimised worker is protected by the Labour Relations Act, and is entitled to contact the South African Police Service (SAPS) and report their employer.</p>

<h2><strong>Government Support And Relief Funds During Lockdown</strong></h2>
<p>As part of the COVID-19 lockdown measures, the Department of Employment and Labour updated legislation on 28 March 2020 with respect to employment and labour issues that arise in these unique circumstances. Part of this amendment to help South Africans get by during lockdown is the COVID-19 Temporary Employer/Employee Relief Scheme (C19 TERS).</p>
<p>The C19 TERS is a special benefit instituted under the Unemployment Insurance Fund (UIF). This measure was created to make provision for situations, in which it will not be economically possible to pay your employees as a result of this lockdown.</p>
<p>In order to make use of TERS funds, companies must meet the following criteria:</p>
<ul>
<li>Registered with the UIF</li>
<li>Comply with the application procedure for this financial relief, which is as simple as sending an <a href="mailto:covid19ters@labour.gov.za" rel="">email</a></li>

									<p>The prominence of the #MeToo movement in the media has thrown a very bright spotlight on inappropriate workplace conduct. The public outcry has forced companies to take a closer look at sexual harassment in the workplace. While all South African companies should have a sexual harassment policy in place as per the Employment Equity Act (by way of the Code of Good Practice), there are many instances of sexual harassment that fly under the HR radar.</p><p><img fetchpriority="high" decoding="async" class="alignnone wp-image-230 size-full" src="https://www.businesslegalinsurance.co.za/wp-content/uploads/2020/01/woman-in-office-on-a-chair.jpg" alt="woman in office on a chair" width="750" height="410" srcset="https://www.businesslegalinsurance.co.za/wp-content/uploads/2020/01/woman-in-office-on-a-chair.jpg 750w, https://www.businesslegalinsurance.co.za/wp-content/uploads/2020/01/woman-in-office-on-a-chair-300x164.jpg 300w" sizes="(max-width: 750px) 100vw, 750px" /></p><h3><strong>What Is Sexual Harassment?</strong></h3><p>The abovementioned Code of Good Practice defines sexual harassment as any unwanted conduct of a sexual nature. The “unwanted” nature of sexual harassment is what separates it from harmless office banter. If a person expresses that they are made uncomfortable by overtly sexual conduct from their co-workers, but that conduct persists, then said individual should take the matter to their company’s human resources department.<br />In the words of the Code of Good Practice:<br />“Sexual attention becomes sexual harassment if: (a) The behaviour is persisted in, although a single incident of harassment can constitute sexual harassment; and/or(b) The recipient has made it clear that the behaviour is considered offensive; and/or(c) The perpetrator should have known that the behaviour is regarded as unacceptable.”<br />The Code of Good Practice describes some forms of sexual harassment, which can fall into the following categories:</p><ul><li><strong>Physical</strong>: all unwanted physical contact, including touching, sexual assault/rape, or a strip search by or in the presence of someone of the opposite sex.</li><li><strong>Verbal</strong>: these can include innuendo, sexual advances, inappropriate inquiries into a person’s sex life, or sex-related jokes or insults.</li><li><strong>Non-verbal</strong>: apart from unwelcome physical contact, non-verbal harassment can include inappropriate gestures, indecent exposure, or the unwelcome display of sexually explicit pictures or objects.</li><li><strong>Quid pro quo</strong>: this form of harassment occurs when a colleague in a more senior role undertakes or attempts to influence the process of employment, promotion, training, or salary increases of an employee or job applicant in exchange for sexual favours.</li></ul><p>Similar to <em>quid pro quo</em> harassment is <strong>sexual favouritism</strong>, which occurs when a person in a position of authority rewards only those who respond to his/her sexual advances. The result of refusing these advances is that more deserving employees are passed over for promotions or salary increases.</p><h3><strong>What Does The Law Say About Sexual Harassment?</strong></h3><p>While office bullying is nothing new, sexual harassment is an equally insidious feature of a poor workplace culture that is often played off as a joke. This is why the human resources department in your company must be easy to approach, while remaining impartial. Having a legal adviser on hand in these matters can be very helpful too, so that employees are well aware of their rights and the HR specialists can learn how to best handle these situations.</p><p>If you are experiencing sexual harassment in your place of work, here are some legislative references you can speak with your HR department about in order to finger out your next steps:</p><ul><li><strong>The Protection from Harassment Act (Act 17 of 2011)</strong>: Part of this act elaborates on types of harassment and stalking behaviours that violate an individual’s right to privacy and dignity.</li><li><strong>The Criminal Law (Sexual Offences and Related Matters) Amendment</strong>: This legislation ensures that complainants of sexual offences are protected, while also seeking to (by way of the relevant legal courses) combat and ultimately eradicate the high incidences of sexual offenses committed in SA.</li><li><strong>The Labour Relations Act</strong>: This is the main act that addresses sexual harassment in the workplace. It’s Code of Good Practice is the backbone of the typical sexual harassment policy for businesses and provides guidance on how to deal with such complaints.</li><li><strong>The Employment Equity Act (Act 55 of 1998)</strong>: This foundational piece of legislation provides protective mechanisms for employees. Section 6 of this act states that no person may unfairly discriminate against another on the grounds of gender, or any other arbitrary ground.</li></ul><h3><strong>What Can You Do About Sexual Harassment In The Workplace?</strong></h3><p>If you are part of your company’s HR department, consider taking the following steps to make sure your office culture supports your colleagues’ productivity and work ethic by making them feel safe at the office:</p><ul><li>Clear policy from management: All employees should have access to and be aware of your company’s policy on sexual harassment.</li><li>Complaints and disciplinary procedure: Make sure all employees know how to report an instance of sexual harassment or other forms of workplace bullying.</li><li>Raising awareness in the workplace: Educate your co-workers on what constitutes sexual harassment by way of a workshop.</li><li>Confidentiality: Ensure that complainants feel safe in sharing their stories. Most victims stay quiet out of fear that reporting their harasser could result in more extreme bullying tactics or that the complainant could lose their position in the company.</li></ul><p>However, the responsibility for tackling the issue of sexual harassment in the workplace cannot be held by HR alone. If #MeToo has taught us anything, it’s that colleagues need to look out for each other in the office. If you are aware of instances of sexual harassment in your workplace, you can make a difference by:</p><ul><li>Reporting these incidents to the attention of management or your human resources department,</li><li>Pressure company management to formulate and implement appropriate policies,</li><li>Helping victims deal with the consequences of this harassment.</li></ul>								</div>

Whether you are a newly established business with a small staff or a longstanding giant in your industry, you should be prepared for potential work interruptions – and strikes are certainly one of them! Ideally, you’re going to want to face the challenge of a strike with a strong legal insurance policy in your corner. If you find yourself having to deal with labour unions and striking employees during a time like this, here are some things to consider.</p>



<p class="wp-block-paragraph"><strong>How To Deal With A Strike</strong></p>



<p class="wp-block-paragraph">Strike action is largely predictable and often falls into a set number of categories. An employed must be quick on his or her feet to stay on top of the situation. There are a number of things you can do to achieve this:</p>

<li>Another traditional response from employers during a strike is a lockout. As the name implies, this is when an employer refuses to allow employees to resume their work.</li>
